With the amendment of the Federal Nature Conservation Act (BNatSchG, Bundesnaturschutzgesetz) in 2002, the special protection of species has been considerably strengthened. These amendments have also been retained in principle in the amendment to the BNatSchG which came into effect on 1 March 2010. Thus, with the transposition of the Habitats Directive into national law, the species listed in Annex IV of the Directive have become strictly protected species in terms of § 10 Para. 2 No. 10, 11 BNatSchG. The §44 BNatSchG defines extensive prohibitions regarding the impairment of the Annex IV species and the European bird species including their breeding sites and resting places. If the conditions are met, an exemption from the prohibitions can be applied for according to § 45 BNatSchG.
